• You are responsible for safeguarding your account credentials and for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.

4. Subscription and Billing

• Subscription Plans: The Service is billed in advance on a recurring and periodic basis (monthly or annually).
• Renewal: Your subscription will automatically renew unless cancelled at least 24 hours before the end of the current period.
• Refunds: All fees are non-refundable unless required by law. We may grant refunds at our sole discretion.

5. Acceptable Use

• You agree not to misuse the Service or assist anyone else in doing so.
• You must not probe, scan, or test the vulnerability of our systems or breach any security measures.
• You must not use the Service for any illegal purpose or to transmit malicious code.

You retain all rights to the data and files you upload to the Service ("Customer Data"). You grant EvalMetric a worldwide license to host, copy, transmit, and display your Customer Data as necessary to provide the Service to you.

7. AI Disclaimer

Our Service uses Artificial Intelligence (AI) to analyze data. You acknowledge that AI outputs are probabilistic and may contain errors. You are solely responsible for verifying any AI-generated insights before making employment decisions.

8. Data Privacy

9. Third-Party Services

The Service may integrate with third-party applications (e.g., LinkedIn, Gmail). Your use of such services is governed by their respective terms and policies.

10. Availability and SLA

• We will use commercially reasonable efforts to make the Service available 24x7, excluding planned downtime.
• We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.

TRAMITE SUA PARTECIPAZIONE DI COLPA POTRÀ ESSERE RESPONSABILE DI UN CAUSA LEGALE VERSO VOI ED I VOSTRI CONSUMATORI PER MOTIVI AZIENDALI COME POTENZIALE PERDITE (GUADAGNO, FILE O MANOMISSIONI DEI VOSTRI CONSUMATORI / CONSEGUENZE ACCIDENTALI O PERDITA). IL TETTO DI LEGGE DEL COMPENSO (MASSIMO / LIMITE DELL'INTESA / IMPUTABILE & RISOLUTIVO), TRA ENTI / PRODOTTI AZIENDA O CLIENTE PER COMPENSAZIONI SARANNO AI LIMITI DI: I TOTALI ECONOMICI RIVERSATI (PER L'ABBONAMENTO DEL SERVIZO) ALL'Azienda NEL RISPETTIVO ED UNICO TRIMESTRE/TRE (3) MESI PRECEDENTI ALL'ORIGINARE DELL'AVVICENDARSI E DEL DENUNCIARSI LEGALE E FORNENDO PROVE O DENUNCIA (ANCHE DEL TOTALE RIMBORSATO SULL'ACCORDO COMPLESSIVO O PRECEDENTI).

14. Indemnification

You agree to indemnify and hold harmless EvalMetric and its officers from any claims arising out of your use of the Service or violation of these Terms.
